State Regulatory Service of Ukraine and experts of the project Transparency and Accountability in Public Administration and Services have developed the first standard of open data set of regulatory agencies in Ukraine, at the initiative of the project Regulatory Map of Ukraine.

Taking into account how urgent it is to have regulatory agencies introduce this standard, on 4 September 2018, the State Regulatory Service of Ukraine and the State Agency for E-Governance of Ukraine held a workshop/presentation on implementation of the first standard of open data set of regulatory agencies in Ukraine.

Event participants learned about provisions of the standard and opportunities of its use for adequate compliance with legislative requirements concerning publication of open data sets of regulatory agencies on the public portal data.gov.ua.

Open data are needed to increase transparency and effectiveness of public and municipal governance and to facilitate development of the economy. They form the basis for successful social and commercial projects.

Open data are often confused with publication of information on the websites of public agencies. In fact, they mean information in open formats which allow its convenient and automatic processing, free use for personal or commercial purposes.

“Implementation of the first standard of open data set of regulatory agencies in Ukraine will facilitate the reform pertaining to deregulation, which aims at reducing the regulatory pressure on business. Simplification of administrative procedures required for economic activity and reducing their number, reducing the number of supervisory agencies and frequency of inspections, annulment of unfounded permits and licenses are all possible thanks to local deregulation. Besides, publication of data by regulatory agencies in compliance with the standard is a powerful tool for the public and the business community, which will allow them to become active participants of regulatory activity, always control the activity of regulatory agencies and track the instances of violation of current legislation by public officials, to stand up for their rights and lawful interests,” says Head of the SRS Kseniia Liapina.

“Open Government policy in Ukraine presupposes that all information available to the state must be available to the citizens and business. Of course, other than personal data and information with restricted access. At the end of 2017, the Government approved an updated Directive 835, which doubled the number of data sets which must be published by public agencies as open data on the single national portal data.gov.ua, bringing the total number of such data sets to 600. Among these sets, information on regulatory acts whose quality and effectiveness directly affect the work of business merits special attention. Thus, today, we are making a confident step towards opening all local regulatory acts based on universal open standards to enable their clear understanding, analysis, comparison – any free use by business, media and the public,” says First Deputy Head of the State Agency for E-Governance Oleksii Vyskup.

“Open, transparent, universally available regulatory policy is a fundamental element of development of the economy and attraction of investments. Not only will it allow citizens and the business to organize their life and work in a better and easier way, but it will also provide a possibility to make plans and forecasts for the future. Transparency of regulatory policy is also an important part of anti-corruption activity, since it is hard for corruption to exist and develop if there is transparency and access. Therefore, our project supports opening a large mass of data which have been closed and unavailable until now,” says director of the TAPAS project Petro Matiyashek.

“Publication of the list of current regulatory acts on the Unified State Open Data Portal is one of the indicators of methodology of the transparency ranking of investment sector. We check whether this list has been published, including when an act came into effect, the deadlines for basic, repeated and regular effectiveness tracking and information on the place of publication. Overall, five indicators in the methodology are related to regulatory policy implementation, and we believe it makes investment sector in cities much more transparent,” explains project manager of Transparent Cities Kateryna Tsybenko.

“The quality of data is one of key issues for the use of open data. For the sets whose publication is required by the law, apart from the general standards set forth in CMU Directive 835 of 21 October 2015, it is advisable to develop certain specific standards which would allow to unify them in some way. We are thankful for support of our initiative and proud to be involved in creation of the first such standard of open data set for regulatory agencies. It is, after all, these very data that have great potential, since they allow to accelerate local deregulation of economic activity and improve administration process by digitization and automation, as it should happen in XXI century,” says member of the Public Council under the SRS, CEO of the project Regulatory Map of Ukraine Oleksandr Pliva.

Among other participants of the event, there were representatives of structural units of oblast state administration on implementation of state regulatory policy, officials of oblast state administrations responsible for publication of public information in the open data format, representatives of Association of Ukrainian Cities and local self-government agencies, civil society organizations, Eastern Europe Foundation, Eurasia Foundation, SRS experts, experts on regulatory policy implementation and the media.
