The organizations which created the Public Integrity Council (PIC) support its requirements concerning the need to introduce changes to the process of qualification assessment of judges. We believe that it is only possible to bring the PIC back to the evaluation process if the High Qualification Commission of Judges follows a number of suggestions, namely:

  • suspend the qualification assessment process until controversial issues are resolved
  • cancel the Regulation on the Procedure and Methodology of Qualification Assessment, clause 46, paragraph 2, which will not allow to dismiss Maidan judges
  • cancel the changes to the HQCJ Regulation in the part concerning the requirements to conclusions and information provided by the Public Integrity Council
  • suspend the HQCJ members with a conflict of interest during the evaluation process or regulate the issue in a different way
  • ensure timely publication of judges’ profiles, including substantiated decisions based on the review of PIC’s conclusions and information, require publication of points received by the judge (candidate) by each member of the commission based on each compliance criterion of the qualification assessment and the name list of voting of the HQCJ members on the PIC conclusions in the Commission’s regulatory acts
  • establish joint criteria of integrity and rules of interaction and communication with the PIC. Namely, provide that the HQCJ delivers to the PIC a definitive list of judges who will undergo evaluation and the schedule no later than 30 days before the interview and does not interview the judge until the PIC submits the assessment result

We believe that only following these suggestions in their entirety will allow to ensure transparency and efficiency of evaluation of judges.

We urge judicial authorities to cooperate with civil society and expect them to engage in constructive dialogue and continue their movement towards openness and transparency.
