It depends on public procurement how transparently and effectively the funds will be allocated for the reconstruction of Ukraine after the war. Therefore, DOZORRO specialists, together with the Department of Public Procurement of the Ministry of Economy, SE “Prozorro,” the Centre of Excellence in Procurement of the KSE, and other experts in the field, are developing new approaches for post-war procurement.
Currently, there are two main scenarios that need to be combined into one.
Approach 1. Divide procurement into two groups: for rebuilding and for the main activity of procuring entities, and introduce different regulation for each of them.
There was a suggestion to make:
- a list of objects that need to be restored;
- a list of goods, works, and services that are necessary for this;
- a register of verified businesses that may become contractors.
Procurement for restoration could then be carried out under an accelerated and simplified procedure, signing contracts with companies from the register for any amounts.
Other procurement transactions — for the main activity of procuring entities — should be carried out according to general rules. At the same time, it is possible to consider shortening procurement periods, including adding services to e-catalogues, raising thresholds, and canceling reports for small amounts.
Approach 2. Introduce a rapid procurement mode for any needs for 1.5-2 years after the war.
Namely:
- set higher thresholds;
- where appropriate, select suppliers from established registers of qualified performers;
- introduce simplified open bidding on the basis of the simplified bidding procedure provided for by the law on defense procurement;
- popularize non-price criteria;
- use the e-catalogue for the procurement of standard goods and services worth up to European thresholds;
- consider the possibility that procurement under the established lists and/or in the identified areas should be carried out by central procurement organizations.
In the future, the working group will focus on selecting the best of both scenarios while minimizing corruption risks and other imperfections.
