										<content:encoded><![CDATA[<p><span style="font-weight: 400;">Before the full-scale war in Ukraine began, we had achieved significant progress in the openness of information. The war changed everything: hundreds of websites were shut down, datasets were concealed, and inquiries for public information went unanswered. The access to public information has regressed.</span></p>
<p><span style="font-weight: 400;">Which data should the local authorities necessarily publish under martial law? What should be done if local governments refuse to provide you with information?  </span></p>
<h2><b>Access to information during war</b></h2>
<p><span style="font-weight: 400;">Public information is information reflected and documented by any means and on any media, obtained or created in the course of the authorities&#8217; performance of their duties. The right of every citizen to access such information is guaranteed by the legislation of Ukraine. </span></p>
<p><span style="font-weight: 400;">However, with the introduction of martial law, a special legal regime began to function. In particular, there is a partial </span><a href="https://zakon.rada.gov.ua/laws/show/254%D0%BA/96-%D0%B2%D1%80/conv#n4271"><span style="font-weight: 400;">restriction</span></a><span style="font-weight: 400;"> of the constitutional right of people to freely collect, store, use, and disseminate information orally, in writing, or otherwise. </span></p>
<p><span style="font-weight: 400;">However, these restrictions apply only in the interests of national security, territorial integrity, or public order. In no way do they abolish the key provisions of the Law of Ukraine </span><a href="https://zakon.rada.gov.ua/laws/show/2939-17#Text"><span style="font-weight: 400;">On Access to Public Information</span></a><span style="font-weight: 400;">. </span></p>
<p><span style="font-weight: 400;">However, sometimes restrictions that do not actually comply with the Law are applied to information. For example, a clause on </span><a href="https://zakon.rada.gov.ua/laws/show/671/97-%D0%B2%D1%80/conv#n118"><span style="font-weight: 400;">force majeure circumstances</span></a> <i><span style="font-weight: 400;">(such as the threat of war or armed conflict, etc.)</span></i><span style="font-weight: 400;"> </span><a href="https://zakon.rada.gov.ua/laws/show/2939-17/conv#n195"><span style="font-weight: 400;">allowed</span></a><span style="font-weight: 400;"> the authorities to postpone consideration of requests for information. It resulted in a negative practice of replying to the inquiries with </span><i><span style="font-weight: 400;">“until the end of martial law.”</span></i></p>
<p><span style="font-weight: 400;">However, the postponement shall only apply for a period of time until these circumstances have been remedied. It should be the result of considering each specific inquiry, and not for all inquiries in general.</span></p>
<p><span style="font-weight: 400;">In addition,</span><i><span style="font-weight: 400;"> </span></i><span style="font-weight: 400;">due to “</span><i><span style="font-weight: 400;">the military aggression of Russia against Ukraine”</span></i><span style="font-weight: 400;"> and the </span><i><span style="font-weight: 400;">“imposition of martial law,</span></i><span style="font-weight: 400;">” the authorities began to establish general restrictions on access to information. But these restrictions should only be applied using the </span><a href="https://zakon.rada.gov.ua/laws/show/2939-17#n40"><span style="font-weight: 400;">“three-part test”</span></a><span style="font-weight: 400;"> on a case-by-case basis. It consists of the following questions:</span></p>
<ol>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Does the classification of information serve the interests of national security, territorial integrity, public order and prevention of offenses, public health, protection of reputation or other rights of people, maintaining prestige and impartiality of justice, non-disclosure of confidential data?</span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Will the disclosure of information cause significant harm to these interests? </span></li>
<li style="font-weight: 400;" aria-level="1"><span style="font-weight: 400;">Does the harm of disclosure outweigh the public interest?</span></li>
</ol>
<p><span style="font-weight: 400;">Information managers must provide opinions on the presence of all these grounds. Otherwise, the restriction of access can be considered unreasonable. We also recommend focusing on the content and updates of information on official portals and social media pages of the local government. To enable residents to exercise their legal right to access public information.</span></p>
<p><b>The imposition of martial law in the country does not give grounds to restrict the right to obtain information.</b><span style="font-weight: 400;"> This is only possible in the interests of national security, territorial integrity, or public order.</span></p>
<h2><b>Closed Open Data</b></h2>
<p><span style="font-weight: 400;">Open data is also public information, but in a format suitable for automated processing. In other words, such information can be processed by software without human intervention. Datasets can be analyzed, compared with others, visualized, and shared in a convenient format. </span></p>
<p><span style="font-weight: 400;">This is an important basis for the work of journalists, think tanks, and CSOs. For example, our Transparent Cities team uses open data to monitor</span><a href="https://transparentcities.in.ua/transparency-rating"><span style="font-weight: 400;"> the level of transparency of local authorities.</span></a></p>
<p><span style="font-weight: 400;">Open data are also useful for residents. In this way, they can find out about the availability of free medicines in hospitals, shelter addresses, current utility tariffs, etc.</span></p>
<p><span style="font-weight: 400;">This information was easiest to find on </span><a href="https://data.gov.ua/"><span style="font-weight: 400;">the Open Data Portal</span></a><span style="font-weight: 400;">, where it was published by cities in particular. However, with the beginning of the full-scale invasion, the portal was closed, explaining it with security risks. In August 2022, access was partially restored in the rear regions, but much of the information on the portal is outdated.</span></p>
<p><span style="font-weight: 400;">In addition, in March 2022, the Cabinet of Ministers of Ukraine provided an opportunity for local authorities to </span><a href="https://zakon.rada.gov.ua/laws/show/263-2022-%D0%BF#Text"><span style="font-weight: 400;">restrict</span></a><span style="font-weight: 400;"> the work of registers. Some city councils closed access to geoportals and open data portals at the request of law enforcement agencies.</span></p>
<p><span style="font-weight: 400;">As a result, as of December last year, </span><b>18 city councils of regional centers published only </b><a href="https://transparentcities.in.ua/articles/vidkryti-dani-mist-v-umovakh-viiny-rezultaty-doslidzhennia"><b>a quarter</b></a><b> of the mandatory sets</b><span style="font-weight: 400;">.</span></p>

<h2><b>Struggle for the right to access: how to obtain the necessary data?</b></h2>
<p><span style="font-weight: 400;">To begin with, check the existing sets on </span><a href="https://data.gov.ua/"><span style="font-weight: 400;">the Open Data Portal</span></a><span style="font-weight: 400;"> or on the website of the data manager (the body that owns the data and is obliged to publish it). If the necessary data are not available, you can send a request to the manager (online or by mail). To do this, use the </span><a href="https://openup.org.ua/odr/index.html"><span style="font-weight: 400;">Inquirer</span></a><span style="font-weight: 400;">, which will form your request for access to public information.</span></p>
<p><span style="font-weight: 400;">The request must be sent to the designated email address, which is indicated on the manager&#8217;s website. If such an option is not provided, send it to the general e-mail in the Contacts section. </span></p>
<p><span style="font-weight: 400;">The information manager should always be required to explain the reasons for refusal. After all, even under martial law, they are obliged to justify denying the access. If your request was ignored or refused, please contact the Ukrainian Parliament Commissioner for Human Rights. Complaints can be sent to the email address </span><i><span style="font-weight: 400;">hotline@ombudsman.gov.ua</span></i><span style="font-weight: 400;"> or in a special </span><a href="https://ombudsman.gov.ua/cabinet"><span style="font-weight: 400;">online form</span></a><span style="font-weight: 400;">. </span></p>
<p><span style="font-weight: 400;">The Ombudsman can open proceedings on the request and file a protocol on the violation of your rights in court. Violators will face an administrative </span><a href="https://zakon.rada.gov.ua/laws/show/80731-10#Text"><span style="font-weight: 400;">fine</span></a><span style="font-weight: 400;">.</span></p>
<p><span style="font-weight: 400;">You can also contact the administrative court at the place of registration — yours or the manager&#8217;s. You will need to pay approximately UAH 900-1,000 of the court fee for one lawsuit. Bank details are available on the websites of the administrative courts which you plan to apply to. </span></p>
<p><span style="font-weight: 400;">To simplify the process of writing an appeal to the court, we recommend using the online designer </span><a href="https://cedem.org.ua/konstruktor-pozovnoyi-zayavy/"><span style="font-weight: 400;">at the link</span></a><span style="font-weight: 400;">. It can be used to write a lawsuit regarding access to public information.</span></p>

<p><b>Trust between society and the authorities is critical,</b> <b>especially in times of war. Equally important is the confidence of international donors that Ukrainian public authorities are open, transparent, and accountable in their activities. However, without access to information, this is extremely difficult to achieve.</b></p>
<p><span style="font-weight: 400;">Our Transparent Cities team is working on a new study on the state of city transparency in conditions of war. We are certain that effective local self-government is the basis for the stability of the state. <p>According to the results of <a href="https://transparentcities.in.ua/articles/vidkryti-dani-mist-v-umovakh-viiny-rezultaty-doslidzhennia">research</a> by the Transparent Cities program<strong>, as of December 2022, the average publication rate of open data in 18 oblast centers is only 25.1%.</strong> This not only makes it impossible for public control over the activities of local authorities, but also indicates a restriction on the constitutional right of people to access information.</p>
<p>On February 24, 2022, the government suspended access to the Unified State Open Data Portal, where, in particular, data were published by cities. Access to the portal was restored in August, but most of the data are outdated, and much of the information has not yet been published.</p>
<p>To date, no changes have been approved to the <a href="https://zakon.rada.gov.ua/go/835-2015-%D0%BF">Resolution</a> No.835 of the Cabinet of Ministers of Ukraine. Consequently, all the data sets listed in it actually remain mandatory for publication by the information managers of local self-government bodies.</p>
<p>Among the sets are those especially valuable for people during the period of martial law. These are data on the location of protective structures of civil protection; accessibility of buildings for people with disabilities; medicine purchased for budget funds, its distribution among health care institutions and balances in each of them, etc.</p>
<p><strong>As a transparency and accountability program, Transparent Cities considers this situation to be harmful. Given the factual closeness of the data, journalists, public activists, and residents cannot quickly obtain, and therefore use, the information they need. Public control over the work of the government is becoming more difficult. There is more room for corruption.</strong></p>
<p>Thus, the temporary restriction of access to certain information during wartime may be justified, but must be explained and meet clear criteria for determining security-sensitive information. We propose to reconsider the approach of chaotic closure of access to open data and be guided by the following principles:</p>
<ul>
<li>Restriction of access should be accompanied by a description of specific risks, possible scenarios for their implementation, and ways to manage them;</li>
<li>Access may be restricted only to such information, the disclosure of which may create risks;</li>
<li>Restrictions cannot apply to information that is available in other public sources or has been made public before.</li>
</ul>
<p>The principles of transparency and accountability should remain cross-cutting aspects in the work of local authorities. Compliance with these principles is the key to economic stability and effective recovery of Ukraine<em>.</em></p>
<p>We call on the information managers of local self-government bodies to urgently restore access to priority data sets, in an amount that does not pose a threat to security, and to publicly justify the closure of information and indicate the grounds on which it was recognized as sensitive.</p>

		<title>Open Data about and for Business: Why Return It</title>

										<content:encoded><![CDATA[<p>At the beginning of the full-scale war, the ministries had to resolve the issues quickly. And although these decisions were not perfect, many of them still had a positive effect. Thus, the duty-free import of cars, although allowed many to renew their fleets, also helped to quickly find cars for the Armed Forces. The opportunity to purchase the necessary things for budget money without tenders allowed to organize procurement at the moment when <a href="https://eba.com.ua/en/pidtrymuyut-komandy-ta-armiyu-yak-pratsyuye-biznes-v-umovah-vijny/">83% of entrepreneurs</a> stopped or reduced their activities, although the accessibility and openness of public procurement has been significantly affected.</p>
<p>One of the steps taken by the government was also the decision of the Ministry of Digital Transformation to close the open data portal. It collected almost all open registers and datasets available in Ukraine. The portal was closed on the caution that the information from there could be used by the russians — at the end of February, there was no opportunity to separately check and weigh the risks for each of them.</p>
<p>However, time was running out. Some challenges were handled, some disappeared, and regarding other officials had enough time to prepare more thought-through and comprehensive solutions. Therefore, the duty-free import of cars was canceled, and the procurement was partially returned to free access for business on Prozorro.</p>
<p>On 1 August, the operation of Open Data Portal was also resumed. However, <strong>it stopped publishing </strong><a href="https://thedigital.gov.ua/storage/uploads/files/%D0%97%D0%BC%D1%96%D0%BD%D0%B8_%D0%B4%D0%BE_%D0%B7%D0%B0%D0%BA%D0%BE%D0%BD%D0%BE%D0%B4%D0%B0%D0%B2%D1%81%D1%82%D0%B2%D0%B0_%D0%BF%D1%80%D0%BE_%D0%B2%D1%96%D0%B4%D0%BA%D1%80%D0%B8%D1%82%D1%96_%D0%B4%D0%B0%D0%BD%D1%96.pdf">141 sets</a> because these data are of potential risk. Among them is the Unified State Register of Legal Entities and Individual Entrepreneurs (USR). The speed of economic recovery, trust in state bodies, and prompt provision of assistance to Ukraine directly depend on its openness.</p>
<h2><strong>Search for Business Development Options and Unoccupied Niches</strong></h2>
<p>The USR contains information about the state of enterprises, their place of registration, what they do. For the business or those who planned to open a business, this was one of the important channels to relatively quickly assess the number of competitors, find potential partners, customers, or suppliers. This helped to make business decisions more quickly and, accordingly, to implement plans, to develop their business and the economy of the country.</p>
<h2><strong>Trust in the Business</strong></h2>
<p>“Is the firm registered in the places of mass registration? Was it created only yesterday? Was the owner the founder of a dozen firms that only existed for a few months? Does the company regularly change owners, or did it move from construction to tailoring a month ago?” is only a small list of questions, the affirmative answer to which means an increased risk that the potential partner is unreliable.</p>
<p>Before the war, the verification of a potential counterparty in the USR became a routine matter, which reduces the risk of loss of funds, and accordingly, contributes to building new partnerships. Since the beginning of the war, this need has not disappeared and has even become more urgent.</p>
<h2><strong>Protection against Seizure of Business</strong></h2>
<p>One of the problems of business is raiding, during which the business is registered to outsiders. The sooner real owners find that they have been excluded from the list of owners, the sooner they will be able to react and the lesser the losses will be.</p>
<p>For this reason, in 2020, the USR began to be publicly updated every day, which allowed quickly tracking the main changes regarding the company. Now, the only way to receive these data directly from the state is to conclude <a href="https://nais.gov.ua/files/general/2021/12/02/20211202092759-55.pdf">an agreement</a> with the state enterprise “National Information Systems” and pay almost UAH 5,000 every month.</p>
<p>The significant threat of losing your business at any moment, not only from shelling, but also from raiding, doesn&#8217;t really prompt to open your own business or expand the already existing one.</p>
<h2><strong>Effective Public Policy</strong></h2>
<p>Thanks to the open USR, authorities at any level could track how their actions impact the emergence of new businesses, re-profiling, relocation, as well as identify negative trends in business development.</p>
<p>These data are useful for international partners. After all, they allow them to understand the economy of the region or a separate sector and, consequently, to better develop a support program or approve a request for financing local initiatives.</p>
<p>Now, because of the changing structure of the market and the need to restore the economy, relevant and accessible information is one of the important factors for timely and effective solutions.</p>
<h2><strong>Trust in the State</strong></h2>
<p>The USR helped to remove the issue of persons receiving illegal benefits from their positions. Who owns a firm that was registered only a month ago and is already winning tenders for billions? Who received state assets or the right to extract materials for nothing?</p>
<p>In addition, openness is an additional shot against slander and information attacks by russians.</p>
<p>Despite the advantages, the opening of the USR may carry a potential risk to the country&#8217;s defense capacity. In particular, publishing the addresses of defense entities can make it easier for the enemy to find targets for attacks, and displaying information about heads of defense enterprises can potentially increase the danger to their lives.</p>
<p>However, these risks can be relatively easily eliminated — it is enough to remove the exact addresses of such enterprises and leave, for example, only the region, not to display information about the heads of defense enterprises.</p>
<p><strong>Therefore, the USR needs to be returned at the moment — the benefits of this for the state and business outweigh the risks. And the latter can be dealt with.</strong></p>
<p>In addition to the USR, the Ministry of Digital Transformation concealed 140 more registers; the risks are not obvious, and their closure could possibly have a significant negative impact. For example, the Public Cadastral Map of Ukraine is important for the normal implementation of land reform and tracking potential abuses. And the Unified State Register of persons who committed corruption or corruption-related offenses allows for better tracking whether recognized corrupt officials continue to receive funds from the state.</p>
<p>Therefore, it is worth checking again all datasets that are to be closed and assess the potential risks and benefits of their publication. If there are no threats, then such a register needs to be published in full. If they there are threats, sensitive information needs to be concealed and the rest of the data published. Complete closure of sets and registers will harm Ukrainians much more.</p>

<p><em>This week, </em><a href="https://www.cosp9.eg/en-us/Pages/Home.aspx"><em>the 9<sup>th</sup> session of the Conference of the State Parties to the United Nations Convention against Corruption</em></a><em> </em><em>is held in Egypt. Andrii Borovyk, executive director of TI Ukraine represented Ukraine at the session dedicated to disclosing information about beneficial owners. Here are the main theses of his speech.</em></p>
<p>Ukraine has disclosed information about the beneficial ownership of all companies at the same time. This is to some extent a new approach because most countries have disclosed this information gradually — starting, for example, with companies in the extractive industry or the media.</p>
<p>As of recently, all companies in Ukraine must submit data on beneficial owners when performing any registration action. On the one hand, we have taken a big step in disclosing these data to everyone, and on the other hand, we have several current problems.</p>
<ul>
<li>The quality of the data entered is questionable</li>
<li>There is currently no identification and verification system</li>
<li>The penalty for failure to provide information is insignificant, and there is simply no responsible government body that would impose penalties for submitting false information.</li>
</ul>
<p>Ukraine has already started to solve the problem with data quality. The Ministry of Justice issued an order according to which data on beneficial owners must be entered in separate fields (until now they were submitted in the same field with the founders and legal owners) and comply with the open data standard, that is, a machine-readable standard.</p>
<p>However, to achieve the goal — to make data about owners not only open, but also convenient to use, we need to:</p>
<ol>
<li><strong>Ensure synchronization of registers</strong>, that is, to introduce automatic “internal” data verification. As part of the Open Government Partnership, Ukraine has committed to verifying data on ultimate beneficial owners. The “homework” has already been done — an audit of existing state registers and databases showed that the owner identification and verification system should cover information from 50 data sets maintained by 21 government bodies. What is left to do is to set up verification in such a way as to see both the ultimate owners of assets, and the relationships between such persons, and the presence of influences on and on the part of the beneficial owner.</li>
<li><strong>Streamline the matter of “beneficial owners in civil society organizations” </strong>(in fact, the idea was to identify the links of such organizations with politicians and parties.) Civil society organizations did not have time to submit this new information within the specified time frame. The government has committed itself to creating conditions for submitting information online, but has not yet developed such a tool.</li>
</ol>
<p>As for the international dimension, the world should move towards creating a single global register of beneficial owners. However, to ensure its correct functioning, it is necessary to develop a unified approach to identifying owners.</p>

<p><a href="https://www.epravda.com.ua/cdn/cd1/karta_derzhavnyh_pidpryjemstv_ukrainy/"><span lang="EN">Map of state enterprises</span></a><span lang="EN">* is a tool designed to help ensure transparency and accountability of state-owned companies and draw attention to their activity.</span></p>
<p><span lang="EN">It allows you to understand which SEs are located on the territory of Ukraine, see their financial indicators and management bodies. By clicking on a specific state enterprise, the reader can go to additional services, view declarations of SE employees and procurement on Prozorro.</span></p>
<p><span lang="EN">“<i>Due to weak control mechanisms and an unsatisfactory level of transparency, SEs can be a source of corruption risks and damage to the state. The map also draws attention to these businesses and should help journalists or citizens find the necessary information</i>,” says<span class="apple-converted-space"> </span><b>Ivan Lakhtionov,</b><span class="apple-converted-space"> </span>deputy director.</span></p>
<p><span lang="EN">Let us remind you that according to the SPFU, there are 3,733 state enterprises in Ukraine. However, not all of them are functioning, and SE performance indicators are often unsatisfactory. More than 1,000 state-owned companies must be declared bankrupt and dissolved. Managing such a large number of SEs requires a significant resource and is inefficient. It is for this purpose that a large-scale privatization has been unblocked in Ukraine.</span></p>

<p>The Ministry of Justice is <a href="https://minjust.gov.ua/news/ministry/denis-malyuska-minyust-zapuskae-onovleniy-edr">launching</a> a new Unified State Register of Legal Entities, Sole Proprietors and Public Associations (USR).</p>
<p>The data will be transferred between August 7 and 16, 2020, and the official launch of the USR is expected on August 16.</p>
<p>Previously, there was one line for “founder” in the USR, which indicated both the founders and the beneficial owners in one field. It would be inconvenient to work with such information, to analyze it. Basically, the name, address, date of birth and other details of the beneficial owner were recorded without separation. All this data is now structured in separate fields and can be analyzed as needed.</p>
<p>In the new USR, the concept of “ultimate beneficial owner” was created, separate from the founder, in accordance with the Law of Ukraine “On Prevention and Counteraction to Legalization (Laundering) of Criminal Proceeds, Terrorist Financing and Financing of Proliferation of Weapons of Mass Destruction.”</p>
<p>Clear structuring and inclusion of information on beneficial owners in separate blocks will <a href="https://ti-ukraine.org/en/blogs/why-improve-the-register-of-beneficial-owners/">help</a> to publish information about the ultimate beneficiary who exercises decisive control over the activities of the legal entity in the format of open data and to control beneficial owners, which will help prevent money laundering and illegal financial flows.</p>
<p>Other expected benefits of the new register include:</p>
<ul>
<li>simplification of user access to the register with a user-friendly web interface;</li>
<li>creation of new registration actions and new forms;</li>
<li>improvement of business registration processes, reflection of the changes, possibility to form the statement after carrying out any registration action;</li>
<li>creation of additional control mechanisms and security modules;</li>
</ul>
<p>It should be noted that information on the ultimate beneficial owner of a legal entity or the founder of a legal entity is submitted and subsequently updated by all legal entities, except for political parties, structural formations of political parties, trade unions, their associations, trade union organizations provided for in the statutes of trade unions and their associations, creative unions, local branches of creative unions, employers&#8217; organizations, their associations, bar associations, chambers of commerce and industry, associations of co-owners of apartment buildings, religious organizations, state bodies, local governments, their associations, state and municipal enterprises, institutions, organizations.</p>

<p>The COVID-19 pandemic demands swift global action. At the time of writing, 164 countries have been affected, more than 200,000 people have been infected and over 8,000 people have died. A growing number of countries have imposed limits on public life to contain the pandemic, restricting non-essential activities such as travel and social gatherings, and closing schools, offices, universities, and recreational spaces.</p>
<div class="bl_copy">
<p>During crises like the outbreak of a deadly virus, the risk of corruption in healthcare is exacerbated by dramatically increased pressure on the system. Disruption, uncertainty and distraction contribute to an environment in which corrupt actors can take advantage of the crisis for their own benefit.</p>
<p><strong>It is essential that transparency, openness and integrity are maintained and extended across the health sector</strong>. We have identified <a href="https://ti-health.org/content/coronavirus-covid19-corruption-health-systems/">several critical anti-corruption measures</a>, including the open publication of research into vaccines and treatments, the protection of whistleblowers in health systems and ensuring equal access to life-saving treatment.</p>
</div>

<p>However, the need for transparency and accountability goes beyond health systems themselves.</p>

<p><strong>EMERGENCY MEASURES</strong></p>

<p>Many countries, regions and cities have declared states of emergency or invoked similar extraordinary powers in order to help prevent the spread of the virus by speeding up decision-making and the allocation of resources. This is important and often necessary.</p>
<p><strong>However, the concentration of power should not, under any circumstances, lead to its abuse. It is vital that emergency powers are exercised only for the purposes for which they were granted.</strong></p>
<p>Fundamental safeguards against corruption must never be weakened or disregarded, otherwise we risk undermining our efforts to serve the public good while the corrupt act with impunity. The Council of Europe <a href="https://assembly.coe.int/nw/xml/XRef/Xref-XML2HTML-EN.asp?fileid=24680&amp;lang=en">states</a> that essential protections to “rule of law, parliamentary oversight, independent judicial control, and effective domestic remedies, must be maintained even during a state of emergency.”</p>
<p>Yet with elections, meetings of parliament and other political activities now suspended over safety concerns in some countries, many normal oversight and accountability processes have been severely disrupted. <strong>Governments should therefore go to extra lengths to act with integrity and be open with the public.</strong> Access to information is key so that there can be accountability in the future for the decisions made now.</p>
<p>Examples from <strong>Serbia </strong>illustrate why this is important. President Aleksandar Vučić has spoken publicly about buying equipment with “no written procurement” adding, “you can prosecute me one day for providing respirators to the people.” While this particular purchase may have been in the public&#8217;s best interest, if we accept the crisis as a reason to reject procurement rules and transparency, it will inevitably lead to corruption. Serbia&#8217;s Prime Minister, meanwhile, has sowed confusion and raised concerns by falsely saying that the number of respirators in the country was a &#8220;state secret&#8221;.</p>

<p><strong>EXTRAORDINARY SUMS</strong></p>
<p>With massive stimulus packages to help economies recover from the impact of the pandemic already being discussed, the current crisis is also a reminder of the importance of transparency in how companies and industries lobby for public funds. Governments must provide reasoned justification for the choices they make to contain the pandemic and boost their economies, so that they secure the public&#8217;s trust.</p>

<p>The media and civil society have an especially important role in providing the public with reliable, independent and up-to-date information during times of crisis. Responsible journalism and civil society expertise can help stop the spread of misinformation and thereby support public trust in government, which is key to effective crisis responses. <strong>These voices must be protected, and emergency powers must never be used to stifle freedom of the press. </strong>In Honduras, however, the constitutional article which protects freedom of expression, including journalistic freedom, <a href="https://cpj.org/2020/03/honduran-government-declares-state-of-emergency-su.php" target="_blank" rel="noopener">has been revoked</a> under a state of emergency related to COVID-19.</p>
</div>
<div class="bl_breaker ">For most people affected by the pandemic, the main focus is on keeping ourselves, our families and our communities safe. However, we must also remain vigilant against threats to freedoms and justice in our societies during these extraordinary times.</div>

<p><span style="font-weight: 400;">On February 24, representatives of state institutions and civic organizations signed a Memorandum of Understanding on establishing a mechanism for verifying information on final beneficial owners and establishing the first Transnational Electronic Laboratory (TeLAB).</span></p>
<p><span style="font-weight: 400;">The executive director of the Transparency International Ukraine Andrii Borovyk signed the document on behalf of the organization.</span></p>

<p><span style="font-weight: 400;">The memorandum was signed for a period of 3 years. It outlines the main areas of cooperation between the parties to create an ecosystem for verifying the credibility of ultimate beneficial owners in order to counteract corruption, money laundering, fraud, tax evasion, and other fraudulent offenses.</span></p>
<p><span style="font-weight: 400;">To achieve this, a </span><b>Transnational Electronic Laboratory</b><span style="font-weight: 400;"> (TeLAB) will be established. It is an official platform for communication and testing of innovative technologies between governmental organizations, NGOs, businesses, and experts at an international level. It will be working on the basis of e-office.</span></p>
<p><span style="font-weight: 400;">The main activities of TeLAB:</span></p>
<p><span style="font-weight: 400;">1) legal: analysis and development of legislation at the international and national levels;</span></p>
<p><span style="font-weight: 400;">2) organizational: development of policies and procedures, analysis of business processes for integration of resources, elaboration of methods of carrying out examinations;</span></p>
<p><span style="font-weight: 400;">3) technical: development, testing and implementation of technical solutions;</span></p>
<p><span style="font-weight: 400;">4) performance monitoring.</span></p>
<p><span style="font-weight: 400;">In addition to the National Bank, the Ministry of Justice, the Ministry of Digital Transformation, the State Financial Monitoring Service of Ukraine, and SE &#8220;National Information Systems&#8221; have also assumed such commitments.</span></p>
<p><span style="font-weight: 400;">Among the partners from the public sector apart from Transparency International Ukraine, the representatives of the public organization Together Against Corruption, Open Up Ukraine, YouControl, International Renaissance Foundation, OpenOwnership, Innovating Governance Association (Austria) also signed the Memorandum.</span></p>

He spoke about the positive experience as well as the challenges that Ukraine encountered along the way. </span></p>

<p><span style="font-weight: 400;">In November 2014 Ukraine became one of the first countries in the world to adopt a law which makes it obligatory for the companies to identify their beneficial owners. This information was stored in the state registry of legal persons, private entrepreneurs and civic unions. But in order to use the registry and search the information on companies sorted by beneficial owners, one needed to pay a fee.</span></p>
<p>&nbsp;</p>
<p>Public officials who submit their declarations in electronic format also have to disclose the companies where they hold the beneficial ownership, does not matter in which country the company is legally registered. Nevertheless, the search mechanism is available only by the officials’ name.</p>
<p>&nbsp;</p>
<p>On May 22, 2017 Ukraine has signed the Memorandum among Transparency International Ukraine and the Ministry of Justice of Ukraine, the State Agency for E-Governance of Ukraine and OpenOwnership to become the first country to integrate its national central register of beneficial ownership with the OpenOwnership Register. It means that Ukraine provided beneficial ownership data to be automatically available on the OpenOwnership Register, which links beneficial ownership data from around the world.</p>
<p>&nbsp;</p>
<p>Starting from August 2017, Ukraine has published its register on open data portal in the open data format available for everyone and the registry is updated regularly. It was also one of the commitments during the Anti-Corruption Summit in London and Paris Declaration during OGP Global Summit to open the registry. In Open Government Partnership Action Plan for 2016-2018, Ukraine made a commitment on making a better mechanism for verification of beneficial owners. The mechanism was not established, but some donors are supporting projects on the verification.</p>
<p>&nbsp;</p>
<p>TI and Open Ownership colleagues identified a number of key areas on which Ukraine needs to focus to improve the situation with disclosure of beneficiary owners.</p>
<p>&nbsp;</p>
<ul>
<li><strong>Level of compliance:</strong>The current low level of compliance (less than 20% of all Ukrainian companies are accounted for) demonstrates the need for a stronger system of sanctions and robust enforcement.</li>
<li><strong>Data quality:</strong>There are currently a number of limitations that lower the quality and usability of the data collected. These include a lack of beneficial ownership data in machine-readable format, unreliable systems of disambiguation for individuals and companies, a lack of granularity in the data (in particular on the means of control), and no representation of chains of ownership.</li>
<li><strong>Maintenance of records:</strong>Currently, no information is given on when the data was submitted, and no confirmation statement is required. This makes it impossible to assess the timeliness of the data being submitted.</li>
<li><strong>Validation:</strong> There is a clear need to close possible loopholes by requiring the reporting of detailed beneficial ownership data, including by using the definition of “beneficial owner” contained in the law as a basis for creating a clear test of beneficial ownership to share as guidance.</li>

										<content:encoded><![CDATA[<p class="capital_letter">State Regulatory Service of Ukraine and experts of the project Transparency and Accountability in Public Administration and Services have developed the first standard of open data set of regulatory agencies in Ukraine, at the initiative of the project Regulatory Map of Ukraine.</p>
<p>Taking into account how urgent it is to have regulatory agencies introduce this standard, on 4 September 2018, the State Regulatory Service of Ukraine and the State Agency for E-Governance of Ukraine held a workshop/presentation on implementation of the first standard of open data set of regulatory agencies in Ukraine.</p>
<p>Event participants learned about provisions of the standard and opportunities of its use for adequate compliance with legislative requirements concerning publication of open data sets of regulatory agencies on the public portal data.gov.ua.</p>
<p>Open data are needed to increase transparency and effectiveness of public and municipal governance and to facilitate development of the economy. They form the basis for successful social and commercial projects.</p>
<p>Open data are often confused with publication of information on the websites of public agencies. In fact, they mean information in open formats which allow its convenient and automatic processing, free use for personal or commercial purposes.</p>
<p>&#8220;Implementation of the first standard of open data set of regulatory agencies in Ukraine will facilitate the reform pertaining to deregulation, which aims at reducing the regulatory pressure on business. Simplification of administrative procedures required for economic activity and reducing their number, reducing the number of supervisory agencies and frequency of inspections, annulment of unfounded permits and licenses are all possible thanks to local deregulation. Besides, publication of data by regulatory agencies in compliance with the standard is a powerful tool for the public and the business community, which will allow them to become active participants of regulatory activity, always control the activity of regulatory agencies and track the instances of violation of current legislation by public officials, to stand up for their rights and lawful interests,&#8221; says Head of the SRS Kseniia Liapina.</p>
<p>&#8220;Open Government policy in Ukraine presupposes that all information available to the state must be available to the citizens and business. Of course, other than personal data and information with restricted access. At the end of 2017, the Government approved an updated Directive 835, which doubled the number of data sets which must be published by public agencies as open data on the single national portal data.gov.ua, bringing the total number of such data sets to 600. Among these sets, information on regulatory acts whose quality and effectiveness directly affect the work of business merits special attention. Thus, today, we are making a confident step towards opening all local regulatory acts based on universal open standards to enable their clear understanding, analysis, comparison &#8211; any free use by business, media and the public,&#8221; says First Deputy Head of the State Agency for E-Governance Oleksii Vyskup.</p>
<p>&#8220;Open, transparent, universally available regulatory policy is a fundamental element of development of the economy and attraction of investments. Not only will it allow citizens and the business to organize their life and work in a better and easier way, but it will also provide a possibility to make plans and forecasts for the future. Transparency of regulatory policy is also an important part of anti-corruption activity, since it is hard for corruption to exist and develop if there is transparency and access. Therefore, our project supports opening a large mass of data which have been closed and unavailable until now,&#8221; says director of the TAPAS project Petro Matiyashek.</p>
<p>&#8220;Publication of the list of current regulatory acts on the Unified State Open Data Portal is one of the indicators of methodology of the transparency ranking of investment sector. We check whether this list has been published, including when an act came into effect, the deadlines for basic, repeated and regular effectiveness tracking and information on the place of publication. Overall, five indicators in the methodology are related to regulatory policy implementation, and we believe it makes investment sector in cities much more transparent,&#8221; explains project manager of Transparent Cities Kateryna Tsybenko.</p>
<p>&#8220;The quality of data is one of key issues for the use of open data. For the sets whose publication is required by the law, apart from the general standards set forth in CMU Directive 835 of 21 October 2015, it is advisable to develop certain specific standards which would allow to unify them in some way. We are thankful for support of our initiative and proud to be involved in creation of the first such standard of open data set for regulatory agencies. It is, after all, these very data that have great potential, since they allow to accelerate local deregulation of economic activity and improve administration process by digitization and automation, as it should happen in XXI century,&#8221; says member of the Public Council under the SRS, CEO of the project Regulatory Map of Ukraine Oleksandr Pliva.</p>

										<content:encoded><![CDATA[<p><em>Acting Minister of Health Ulana Suprun has signed documents on the free transfer of intellectual property rights from the public to the Ministry of Health</em><em>care</em><em>. The development of the MVP (minimum viable product) of the National Healthcare System was coordinated by the Project Office created by Transparency International Ukraine and the All-Ukrainian Network of PLWH. Funding was provided by international donors &#8211; US and Canadian Governments, the Global Fund, and others. From now on, the Ministry of Health</em><em>care</em><em> will take care of the further development and implementation of eHealth, for which the </em><em>state enterprise </em><em>Electronic Health was created in December 2017. Other documents required to </em><em>formalize</em><em> the transfer of eHealth from international donor organizations to the state will be prepared and signed shortly.</em></p>
<p>The eHealth system has been operating in test mode from September 2017, when the registration of a medical facility and doctors in the system was made technically available, as well as entering the data of patient declarations. After the adoption of the Law of Ukraine &#8220;On State Financial Guarantees of Public Health Care&#8221; and the establishment of the National Health Service, the state will be able to pay a physician for each patient, and the patients will receive free medical services guaranteed by the state. Thus, eHealth will help realize the principle of &#8220;money follows the patient.&#8221;  Apart from that, the eHealth system contains a functionality developed on the basis of the central component to support the &#8220;Affordable Medicines&#8221; program.</p>
<p>Ulana Suprun thanked the Project Office team and noted that this work had become an example of how not only to develop an important IT product for the state in the short term. Most importantly, the principles and values ​​that the public, the state and business declared at the beginning of the project, while signing a joint Memorandum, were respected. &#8221; We are very eager to see eHealth working no longer in the test mode, and the doctor&#8217;s activities containing less paperwork and more of engagement with the patient. We are grateful and have learned a lot in cooperation with your team. You have created a truly unique thing,&#8221; added Acting  Minister of Healthcare.</p>
<p>&#8220;With donor support, the eHealth Project Office has developed the functionality that was required by the Ministry of Healthcare to initiate the medical reform. We managed to offer such architecture and software components which allow us to develop a full-fledged eHealth system in Ukraine at a minimum cost. This is confirmed by the results of a technical evaluation carried out by an independent expert at the request of the Ministry. The expert made a clear conclusion about the compliance of the proposed solution with the declared characteristics and the signed Memorandum, and MVP eHealth is recommended for commissioning without further reservations. So, from now on, the Project Office at TI Ukraine will cease its activities, but some team members will continue to support eHealth until the information is completely passed on to the team of the Ministry of Healthcare and the newly created SE Electronic Health, &#8221; commented Yurii Buhai, Head of the eHealth Project Office.</p>
<p>&#8220;The first stage of implementation of any changes is the most difficult,&#8221; said Yaroslav Yurchyshyn, executive director of Transparency International Ukraine. “We expect the state to provide leadership and proactivity in the further development and implementation of the electronic healthcare system.The MoH has declared a very ambitious program of change, and we will have to overcome a lot of obstacles along the way. We have virtually created the future for us today, but what it is going to be like depends on all of us. From now on, the task of the public sector is to ensure that the pace of this reform is stable, and eHealth development continues with the observance of the declared principles&#8221;, he added.</p>
<p>Dmytro Sherembey, chairman of the Coordinating Board of the All-Ukrainian Network of PLWH, noted that the introduction of the National Electronic Health Care System aims to save patients&#8217; lives. After all, transparency and access to information is a prerequisite for every Ukrainian citizen to receive accessible and timely medical care. &#8220;It is important that every patient knows his doctor and receives qualitative help and each doctor has a clear and honest motivation,&#8221; said Dmytro.</p>

At the press-conference, the participants will talk about the work that Ukraine is doing on implementation of the principle of transparency of beneficiary ownership, how the register of data on beneficiary owners works, Ukraine&#8217;s achievements and challenges in this area. It is noteworthy that, as of now, there are only two countries which have disclosed the data on beneficiary ownership &#8211; Ukraine and the UK.</p>

<p>A vital step has been taken to implement the previously signed <a href="https://ti-ukraine.org/en/news/memorandum-of-global-partnership-to-disclosure-of-beneficial-owners-was-sign-on-may-22nd/">Memorandum of Understanding</a> and develop cooperation between the Ministry of Justice of Ukraine, the State Agency for E-Governance, Transparency International Ukraine and the <a href="https://register.openownership.org/">OpenOwnership </a>consortium to transfer information about beneficial owners to the Global Registry.</p>
<p>The Prime Minister of Ukraine, <strong>Volodymyr Groysman</strong>, <em>on his Facebook page commented: &#8220;Good News! Ukraine has launched data on beneficiaries of companies and has become the first country in the world joining the Global Registry of Beneficial Owners &#8211; the Transparency International Initiative to Promote Transparency and Fight Corruption.</em> <em>Open data is the core for building a transparent and efficient state, as well as a powerful source of development for commercial and community projects. As a result, media and the public can easily use and analyze open data to ensure public control, and IT-business &#8211; to create new online services and projects that will enrich the economy and will be useful to its users. Open Ukraine Together!</em>&#8221;</p>
<p>Disclosure of beneficial owners is one of the obligations under the National <a href="http://www.kmu.gov.ua/control/uk/cardnpd?docid=249552867">Action Plan</a> and the Paris Declaration on the Implementation of <a href="https://www.opengovpartnership.org/">Open Government Partnership Initiative</a>, as well as the outcome documents of the Anti-corruption Summit in London in 2016. Available end-user data is important for fighting corruption and corporate accountability issues. After the launch of the Global Registry in April 2017, Ukraine has become the first country which officially confirm its willingness to integrate data on beneficiaries in an electronic format.</p>
<p><em>&#8220;Ukraine is developing new ways to cooperate within the global partnership initiative taking part in development of the Register of Beneficial Owners. Disclosure of beneficiaries can be considered as the launch of a powerful tool for fighting corruption and preventing grand corruption,&#8221;</em> explained <strong>Yaroslav Yurchyshyn,</strong> executive director of TI Ukraine.</p>
<p>To launch the Global Registry of the beneficial owners, a great contribution was made by a consortium of international organizations: <a href="https://www.transparency.org/">Transparency International</a>, <a href="https://opencorporates.com/">OpenCorporates</a>, <a href="https://webfoundation.org/">World Wide Web Foundation</a>, <a href="https://www.globalwitness.org/ru/">Global Witness</a>,<a href="http://bteam.org/"> the B Team</a>, <a href="https://www.one.org/international/">ONE Campaign</a> та <a href="https://www.open-contracting.org/">Open Contracting Partnership</a>. This step is the result of the member countries political will as a part of the global Anti-Corruption Summit held in London in May 2016. The Registry has become an authoritative source of information about the company and organizations owners. These data will link different jurisdictions, sectors, and databases.</p>
<p><em>&#8220;Dream, faith in the victory, reliable and responsible partners, well-developed strategy and tactics is the key to achieving results in the near future. Another challenge is to integrate our data into the Global Register of Beneficial Owners and present the results during the UN General Assembly in September this year,&#8221;</em> said <strong>Olesia Arkhypska</strong>, Transparency International Ukraine, expert on governance, member of the Coordination Council on the implementation of the Open Government Partnership Initiative.</p>

<p><strong>July 27, 2017</strong> &#8211;  the official invitation on behalf of the leaders of The B Team to <strong>the President of Ukraine Petro Poroshenko</strong> to participate in the Plenary Session &#8220;Toward a New Trust: Serving Public Interests Through Transparency and Integrity&#8221; between Heads of State, global business and civil society leaders, on September 19, 2017, New York, USA during the UN General Assembly</p>
<p><strong>June 16, 2017</strong> – <a href="https://ti-ukraine.org/en/news/memorandum-of-global-partnership-to-disclosure-of-beneficial-owners-was-sign-on-may-22nd/">Memorandum of Understanding</a> <em>and Cooperation was signed between the Ministry of Justice of Ukraine, the Ministry of Agrarian Policy and Food of Ukraine, the State Agency for E-Governance of Ukraine, Transparency International Ukraine and BitFury Holding BV. On the development of blockchain technology at state registers and land cadastre, development of the first Development Index of blocks in the public sector and the receipt of the first data audit node for a public organization.</em></p>
<p><strong>On June 14, 2017</strong> – the international initiative “Open Government Partnership” <a href="https://minjust.gov.ua/news/ministry/mijnarodna-initsiativa-partnerstvo-vidkritiy-uryad-privitala-ukrainu-z-priednannyam-do-globalnogo-reestru-realnih-vlasnikiv-pidpriemstv---minyust">congratulated </a>Ukraine, the first of all countries which joined the Global Register of Beneficial Owners.</p>

Taking</em> <em>into</em> <em>account</em> <em>the</em> <em>latest</em> <em>events</em> <em>concerning</em> <em>the</em> <em>pressure</em> <em>of</em> <em>law</em> <em>enforcement</em> <em>on</em> <em>businesses</em> <em>in the field of</em> <em>open</em> <em>data</em><em>, Transparency International </em><em>Ukraine</em> <em>considers</em> <em>the selective approach of law enforcement bodies on these businesses unacceptable and proposes to increase the quantity and quality of open registers.</em></p>
<p>The pressure of the Security Service of Ukraine on businesses in the field of open data caused a wave of outcry among investigative journalists and civil corruption fighters, for whom the work with open data is a professional need. Instead of expanding the quality and quantity, of filling up the registries and bringing them in accordance with the law, to protect the restricted data according to the law, the State decided to fight some specific representatives of businesses which provide data collection services.</p>
<p>According to the Executive Director of Тransparency Іnternational Ukraine, Yaroslav Yurchyshyn, the Security Service of Ukraine should fight the problem at its source, not its consequences: «We stand for two approaches. The first one is to provide protection of/for restricted registries and to fight the illegal sale of their data. The second is to open all the registers permitted by the law, which are of great public interest. In Great Britain, for example, there is free access to <a href="https://beta.companieshouse.gov.uk/">company registers </a>containing all the information about their history, reports, employees, etc.  In Ukraine, the data on final beneficiaries and company founders that are still not publicly available and not entered in the auto register of the Ministry of Justice (АРІ)».</p>
<p>According to the Law of Ukraine “On Access to Public Information», in case of great public interest (a number of requests) information managers can make a set of additional non-confidential data public.</p>
