Over the past month, ARMA has repeatedly resorted to manipulations in its public communication about Draft Law No. 12374-d. The following are some examples.

Yesterday, April 24, ARMA published a message on its official channels with a bold headline: “The Verkhovna Rada Law Enforcement Committee – Draft Law No. 12374-d Should Be Finalized Together with ARMA.”

However, this statement is not true, as evidenced by the official rebuttal from the Verkhovna Rada Law Enforcement Committee. The rebuttal states that ARMA’s information is inconsistent with the facts. The Committee emphasized that the draft law was not considered at all during its meeting, meaning that the Committee, as a collegial body, did not express any position on this regulation.

This is not the first instance of such manipulation by ARMA — a similar situation occurred with the conclusion of the Committee on European Integration. At that time, ARMA claimed that the Committee had allegedly decided to “significantly finalize Draft Law No. 12374-d for the second reading in accordance with ARMA’s comments.”

However, the official conclusion of the Committee on Ukraine’s Integration into the EU says otherwise: “The Draft Law does not contradict Ukraine’s international legal commitments in the field of European integration, but needs to be finalized in view of the comments made.” The conclusion does not contain a single word about the need to take ARMA’s comments into account.

Moreover, it clearly states that the amendments proposed by the draft law “do not contradict the Association Agreement and will also contribute to the implementation of the European Commission’s recommendation.”

What motivates ARMA to resort to such manipulation? Perhaps it is because Draft Law No. 12374-d significantly increases transparency in the Agency’s activities, expands public reporting requirements, and introduces clear mechanisms for managing recovered assets.
