HACC issued a guilty verdict in the case of Yevhen Dykhne, former General Director of Boryspil State Airport, and Olesia Levochko, Head of the Non-Aviation Contracts Service at Boryspil Airport.

Dykhne is sentenced to 5 years in prison with deprivation of the right to occupy organizational and administrative positions for 3 years and the imposition of a fine. Levochko is sentenced to 4 years in prison with deprivation of the right to hold organizational and administrative positions for 3 years and a fine.

Moreover, the Anti-Corruption Court partially satisfied the civil claim of the SPFU and decided to collect UAH 10.5 mln from the accused jointly and severally.

Dykhne and Levochko were accused of abuse of office due to the provision of benefits to LLC Kofe Bar Plius, LLC Arteriia Hrup, and individuals who are the beneficial owners of these legal entities. It is about State Enterprise Boryspil International Airport concluding preliminary lease agreements with 2 lessees without competitive selection and without involving the Regional Branch of the State Property Fund of Ukraine and the Ministry of Infrastructure of Ukraine.

Prosecutors claimed that as a result of the actions of the accused, the national budget and SE Boryspil International Airport failed to receive rent in the amount of more than UAH 16 mln, which would have been received if the procedure established by law had been followed.

There were also two victims in the case:

  • Regional branch of the State Property Fund of Ukraine in Kyiv, Cherkasy, and Chernihiv oblasts;
  • State Enterprise Boryspil International Airport.

At the same time, the representative of Boryspil stated that the company had not suffered any losses.

The decision of the HACC can be appealed in the appellate instance within the next 30 days.
