The National Agency on Corruption Prevention does not see grounds to take any action concerning the Ukrainian chapter of the international anti-corruption organization Transparency International at the request of Servant of the People MP Oleksandr Dubinskyi.

This was the Agency’s response to the information request of ZMINA.

According to the available data, on September 18, the NACP received a request from MP Oleksandr Dubinskyi concerning the fact that members of the Board of Transparency International Ukraine CSO failed to file electronic declarations for year 2017.

The Agency cited the 2019 Constitutional Court decision, which ruled declarations of activists to be unconstitutional, while Ukrainian laws do not have retroactive power unless it leads to mitigation or cancellation of a person’s liability.

“Thus, private individuals who govern or participate in the highest governing bodies or other governing bodies of civic associations which perform anti-corruption activity, implementation of anti-corruption policy standards, monitoring of anti-corruption policy in Ukraine, development of positions on formation and implementation of such policy, and/or participate in measures connected with preventing and combating corruption are not obligated to file declarations,” says the NACP response.

In addition, the Agency does not see the conflict of interest alleged by the MP in his request.
